General Terms and Conditions

Validity:
The following General Terms and Conditions apply to this contract between Siegfried Kuschmierz OHG and the client. They do not apply if the parties have made a different arrangement in individual cases.

General Terms and Conditions of the client:
General terms and conditions of the customer shall not become part of the contract, even if Siegfried Kuschmierz OHG does not expressly object to these terms and conditions.

Retention of title:
Items delivered by us shall remain the property of Siegfried Kuschmierz OHG until payment has been made in full, unless ownership is transferred to the customer for legal reasons. Siegfried Kuschmierz OHG is entitled to procure ownership of the delivered items for the customer and to demand an advance payment for the delivery of the transferred items. In the store, unless otherwise agreed, cash on delivery by UPS and prepayment for deliveries abroad.

Warranty:

If a service provided by Siegfried Kuschmierz OHG is defective, the customer may demand subsequent performance. If the defect is not remedied by the supplementary performance of Siegfried Kuschmierz OHG, the customer may reduce the remuneration of the order value.
Subject to the following provision on liability, the client shall not be entitled to any further warranty rights. The warranty period is one year, unless otherwise agreed.
An obvious defect can only be reported within two weeks of the start of the warranty period. A defect is obvious if it is apparent to a non-expert client without closer examination of the service provided.
The notification of a defect is only effective if it is made in writing.

Liability:

The liability of Siegfried Kuschmierz OHG for damage caused by delivered goods is excluded. Furthermore, no liability is accepted for improper use.

Invoices and payments:

Invoices can no longer be objected to two weeks after receipt by the client.

Complaints must be made in writing.
Each invoice must be paid immediately upon receipt by the parcel service without deduction.
Siegfried Kuschmierz's demand for any payments on account does not require that the contractor's services for which the payment on account is demanded are proven by a list which enables a rapid and reliable assessment of the service.
